These Terms of Service govern your use of this website and every order you place with JDM of Washington, whether online, by phone, by email or in person. Our Legal Notice, Privacy Policy and the other policies linked at the end of this page are part of these Terms.
1. Acceptance of These Terms
By browsing this website, creating an account or placing an order, you agree to these Terms and to the policies they reference. If you do not agree, please do not use this website or buy from us.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to buy from us. If you order on behalf of a business, you confirm that you are authorized to bind it. We may refuse or cancel an order from anyone we reasonably believe is not eligible or is using an unauthorized payment method.
3. Our Products Are Used Parts
Everything we sell is used. Our engines, transmissions, front clips and parts are imported directly from Japan from vehicles that were previously driven. Mileage figures are approximate and based on Japanese auction or export documentation that we cannot independently verify. Listing photos may be sample photos of a similar unit rather than the exact unit you receive.
Every engine is inspected and hand-turned 15 to 20 times before it leaves our warehouse so that you can confirm it is not seized. These checks confirm basic condition at the time of shipment; they are not a promise that a used part will perform like a new one. See our Disclaimer for more about mileage, photos and fitment.
It is your responsibility to confirm that a part fits your vehicle before you order. Engine codes, year ranges and included accessories vary, so check the VIN and engine code with a qualified mechanic first. We do not accept returns because a part does not fit, unless the listing itself was wrong.
4. Orders and Acceptance
Placing an order is an offer to buy. We accept that offer only when we send a shipping confirmation or hand the item to you at pickup; an order confirmation email means we have received your order, not that we have accepted it. We may refuse or cancel any order before acceptance for any reasonable cause, including an item being sold or damaged before your order was processed, a listing error, suspected fraud or a destination we cannot serve. If we cancel, we will tell you promptly and refund everything you paid.
5. Pricing and Errors
Prices are in U.S. dollars and exclude shipping, delivery and sales tax unless the listing says otherwise. Washington sales tax is added at checkout where required. We may change prices at any time, but not for an order we have already accepted.
A listing may occasionally show an incorrect price, description or availability. If an error affects your order, we will contact you and offer the choice of continuing at the correct price or cancelling for a full refund. We are not obligated to sell an item at an incorrect price.
6. Payment
Online orders are paid through Shopify checkout using Visa, Mastercard, American Express, Discover, Shop Pay, Apple Pay or Google Pay. Pickup orders may be paid in person at the Auburn warehouse. Checks are accepted only by prior arrangement, and a $35.00 service charge applies to any returned check. We do not offer financing. Payment must be received in full before an item ships or leaves the warehouse. See our Payment Policy.
7. Shipping and Risk of Loss
Engines, transmissions and other large items ship by LTL freight on a pallet or in a crate. Shipping is quoted per order; contact us for a quote. Delivery typically takes 7 to 14 days after the order ships, but transit times are estimates, not guarantees. Shipping fees are non-refundable.
Title and risk of loss pass to you when the carrier delivers the shipment. Inspect it before signing, note any damage on the bill of lading and report damage to us within 48 hours with photos so a carrier claim can be filed. We are not responsible for transit damage that is not noted at delivery. See our Shipping Policy.
8. Local Pickup
You may pick up your order free of charge at our Auburn warehouse during business hours. Bring a truck or trailer suitable for the item; we will load it. Title and risk of loss pass to you when the item is loaded. Inspect the item and hand-turn the engine before you leave; once you accept it, we cannot take claims for cracks, physical damage or a seized engine. Orders not collected within 14 days of our pickup-ready notice may be cancelled under our Cancellation Policy.
9. Cancellations
You may cancel an order before it ships or is picked up by calling or emailing us. Online orders are subject to a 2.90% cancellation fee that covers our non-refundable payment processing costs. Deposits are non-refundable. Once an order has shipped, a cancellation is treated as a return. Full details are in our Cancellation Policy.
10. Returns and Refunds
Used parts and accessories are final sale. Engines and transmissions may be returned only for a warranty defect or with our prior written approval, subject to a 35% restocking fee plus original and return freight. Refused deliveries are treated as returns. See our Return & Refund Policy.
11. Warranty
Eligible engines and transmissions carry a limited warranty on the head and block internals only, subject to the installation requirements, exclusions and claim procedure in our Warranty Policy. All electronic components, rotary engines, accessories and used parts are sold AS IS, WITH ALL FAULTS. Except as expressly stated in the Warranty Policy, we disclaim all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. Some states do not allow the exclusion of implied warranties, so some of these limitations may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, JDM of Washington will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of this website or any product we sell, including labor, towing, rental cars, lost profits, loss of use, fluids and damage to other parts of a vehicle, even if we were told such damages were possible.
Our total liability for any claim relating to a product will not exceed the amount you paid us for that product, and for any claim relating to this website that does not involve a purchase it will not exceed $100, regardless of the legal theory. Some states do not allow the limitation of incidental or consequential damages, so these limits may not apply to you in full.
13. Indemnification
You agree to defend, indemnify and hold harmless JDM of Washington and its owners, employees and agents from any claim, loss or expense, including reasonable attorney fees, arising from your breach of these Terms, your misuse of this website, your installation or use of a product we sold you, or your violation of any law or third-party right.
14. Prohibited Uses
You agree not to:
- use this website for any unlawful purpose or in violation of any local, state, federal or international law;
- place fraudulent orders, use a payment method you are not authorized to use, or initiate a chargeback for an order you received as described;
- copy, scrape, harvest or republish our listings, photos, prices or other content without written permission;
- interfere with the security or operation of the website, introduce malicious code, or attempt to gain unauthorized access to any account or system;
- impersonate another person or misrepresent your relationship with any person or business;
- use any automated tool to access the website other than standard search-engine indexing;
- harass, threaten or abuse our staff.
We may suspend or terminate your access and refuse future orders if you violate these rules.
15. User Content
If you submit a review, comment, photo or other content to this website or to us by email, you grant JDM of Washington a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit and display it in connection with our business, including on this website and in our marketing. You confirm that you have the right to share the content and that it does not infringe anyone else's rights, is not defamatory and does not contain personal information about anyone other than you. We may remove any content at our discretion.
16. Third-Party Links and Services
This website may link to other websites, such as carrier tracking pages, payment providers or social media. We do not control those sites and are not responsible for their content, accuracy or privacy practices, and a link is not an endorsement. Your use of any third-party site is at your own risk and subject to that site's terms.
17. Governing Law and Venue
These Terms and any order placed with us are governed by the laws of the State of Washington and applicable federal law, without regard to conflict-of-law principles. Any lawsuit arising out of these Terms, this website or a purchase from us must be brought in the state courts located in King County, Washington, or in the United States District Court for the Western District of Washington, and you consent to the jurisdiction of those courts. Before filing suit, both parties agree to attempt to resolve the dispute through the 30-day good-faith negotiation described in our Legal Notice. These Terms do not require arbitration and do not waive your right to bring a class action.
18. Entire Agreement and Severability
These Terms, together with the policies they reference and the details of your order, are the entire agreement between you and JDM of Washington regarding your purchase and your use of this website. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest of the Terms will remain in effect. Our failure to enforce a provision is not a waiver of it.
19. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page shows when they were last changed. The version in effect when you place an order applies to that order, and continuing to use this website after a change means you accept the updated Terms.
